Due to the closure of the ineffective Prime Ministry Property Complaints Office the issues and complaints you have need to be dealt with by the relevant government departments and regulatory bodies.

General Issues

PTP: If you can please visit the Interior Ministry with your application number to check on it's current status (see directions in left hand column).  If you are not in a position to check yourself please let us know your file number and the name(s) of the applicant(s).

 

Building Permit: Please read the Property Quiz in the left hand column. If you are not certain that there is a building permit for your property or site please ask your vendor or lawyer to give you a copy of the Building Permit (Bina Ruhsati) or the 'B' (project) file  number.

If they won't or can't supply either the permit or the file number please visit your local Belediye office with your sales agreement, copy koçan and district site plan to enquire if they can help (they are not obliged to give you any information).

If the Belediye can't help please visit the local Kaymakamlik (District Office) with the same documents.

If you do know the 'B' file number and are not certain if the building permit has been paid for and issued the Kaymakamlik will give you this information.

NOTE: if your site is large it may have more than one building project file.

 

Final Approval: When all the work has been completed in accordance with the the project submitted the vendor can apply for final approval. The cost of this is 10% of the building permit/licence fee and normally works out at no more than 70 lira per property. The Kaymakamlik will also assist you with this issue.

NOTE: Please do not make any structural changes to your property or plot until you are certain the Final Approval Certificate has been issued.

 

Perselisation: Perselistation is the process of separating undivided land into single koçans, measuring and certifying each of the divided plots and registering the property on the koçan. If this is not applied for before building commences it can not then be applied for until a Final Approval certificate has been paid for and issued.

If all the buyers are in possession of a Share (Hisse) koçan you can apply collectively. A list of companies certified to carry out parcelisation is available by e-mailing marian.hbpg@gmail.com or at the Pia Bella every Tuesday. Percelisation should cost no more than £700 per property.

COMPLAINTS

Lawyers

Thanks to the hundreds of you who took time to complete the Lawyer Assessment Form which provided vital information for us to determine the extent of the issues caused by some lawyers. As a result of your input the TRNC Bar Council are now taking all complaints against lawyers seriously. A register of complaints is now in operation, the first on the register being dated February 2006.  However. the majority of complaints currently on the register are not set out in a factual manner and the relevant evidence is not attached.  Also, the members of the Disciplinary Committee do not speak English and these complaints have not been translated into Turkish. Please re-write your original complaint and re-submit it in Turkish.

The Bar Council have asked that you send your complaints in Turkish to them and have assured us that they will be taken very seriously from now on. Your complaint must be factual and you must attach any documents that back up your statements.  A sample document is provided in the left hand column of this page.

Please send your translated complaint by e-mail to kktcbarolarbirligi@gmail.com and an English version to marian.hbpg@gmail.com.  We will have regular meetings with the Bar Council to follow progress on your complaint and you will be advised accordingly.

We also intend taking a class action case against at least one lawyer for gross negligence and/or fraud. If you think this should be against your lawyer and you are willing to contribute towards the cost, please e-mail marian.hbpg@gmail.com

Builders

Estate Agents

The Estate Agents Union are also taking buyer's complaints seriously if you forward a factual account of your issues to cteaa@cteaa.org, with a copy to marian.hbpg@gmail.com  We will also have regular meetings with the Estate Agents Union to follow progress.

 

General consumer complaints

Please contact the Consumer Association on 0392 228 9520 or e-mail tukder@superonline.com.  If you have a complaint it is best to make an appointment with Hasan Yilmaz Işık. You will be charged a fee for this service.

 

Registering your problem/complaint will not jeopardise any negotiations you are involved in with your builder or anyone else.  If you do not want the illegal building to continue you must inform the correct authorities as they are the only people who can correct the mistakes of the past and ensure that all property investments are secure in the future.
