    What do you know about your purchase?

    If you are unable to answer all of these questions you have some research to do.  If you need any help on how to get the information please come along to the Pia Bella any Tuesday from 12 noon onwards

    Did you sign the sales agreement yourself?

    If yes:

    • were all the parties to the contract present and did you all sign 3 copies together?

    • were the witnesses present and did they actually witness all signatures?

    • did you ask for ID from all the signatures?

    • did you retain one of the originals?

     

    If not:

    • was your sales agreement signed by a third party under Power of Attorney from you?

    • are you confident that it was signed and witnessed by all parties at the same time?

    • do you know the ID number (passport or kimlik) of all parties?

    Were all related documents attached to the sales agreement?

    • copy koçan

    • original certified district site plan

    • building permit

    • all structural and electrical plans

    • if there is a third party landowner involved - a copy of the Agreement between builder and landowner?

    • copy of all related Power of Attorney documents?

    • any other documents, i.e. choice of fixtures and fittings, agreed extras?

     

    If yes:

    • did you pay stamp duty at 0.5% of the contract price to the local tax office?

    • have you got the tax office stamped sales agreement and receipt for payment?

    • were all documents registered at the District Land Office within 21 days of signing the agreement?

    • do you have the District Land Office A34N registration form and receipt for payment?

    Was your permission to purchase applied for immediately?

    If yes, were all the following documents included with the application:

    • fully completed application form

    • copy koçan

    • original certified district site plan

    • copy of stamped sales agreement

    • a Police reference from your last country of residence

    • a letter of application

     

    If not, do you know that:

    • even if you get a permission to purchase application number your file will not be processed by the Interior Ministry until all the information is supplied and correct.

    Do you know if parcelisation/sub-division was applied for and granted?

    If yes:

    • did you receive a copy of the individual koçan?

    • was that koçan supplied to the Interior Ministry for your permission to purchase file?

    Did you know that under Specific Performance Law all the terms of your sales agreement must be carried out within 2 months of the date of signing?

    Did you know that this is impossible:

    • if you buy off plan

    • if your permission to purchase is not approved within that timescale

    If the terms of your sales agreement were not honoured to your satisfaction have you taken legal action against all parties involved in the sale?

    If yes:

    • did you enter into an official agreement with the lawyer taking the case on your behalf, outlining the total costs and obligations of the lawyer.

    • do you know your court case number

    • did you get an independent translation of your case and all evidence?

    • are you confident that the case has been properly prepared?

    • are you confident that you are being properly informed and properly represented in court?

    • have you paid the lawyer in advance?
